Welcome to Quickizz! These Terms of Service ("Terms") govern your use of the Quickizz Telegram Mini App, Telegram Bot, website, and related services (collectively, the "Service") operated by Don't Miss Out Ventures Inc. ("we," "us," or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Description of Service

Quickizz is a flight availability monitoring service that helps users find available seats on flights, particularly for airline subscription programs such as All You Can Fly (AYCF). Our Service:

Monitors flight availability within specified booking windows
Sends notifications about available flights via push alerts and in-app messages
Provides flight deal reports based on your preferences
Does NOT book flights on your behalf

Important: Quickizz is an independent service and is NOT affiliated with, endorsed by, or connected to Wizz Air, Ryanair, easyJet, or any other airline. We are a third-party tool that helps you find flights.

1A. Flight Data and Accuracy

Flight information displayed in Quickizz is based on our own monitoring and analysis of publicly available data. Flight availability is dynamic and changes constantly. Displayed flights may no longer be available by the time you attempt to book, may have different schedules, or may not be bookable under your specific membership terms.

You must always verify flight details and availability directly with the airline before making any travel plans or financial commitments. Quickizz is a discovery and alerting tool, not a booking system.

2. Eligibility

To use the Service, you must:

Be at least 16 years of age
Have a valid account with the Service
Have the legal capacity to enter into a binding agreement
Not be prohibited from using the Service under applicable law

3. Account and Registration

When you start using Quickizz, an account is automatically created for you using your profile information. You are responsible for:

Maintaining the security of your account
All activities that occur under your account
Providing accurate information when prompted

4. Subscription Plans and Payments

4.1 Free Trial

New users receive a 72-hour free trial with full access to the Service. No credit card is required for the trial. After the trial ends, you may continue with our Free plan or upgrade to a paid subscription.

4.2 Subscription Plans

We offer various subscription plans with different features and pricing. Current plans and pricing are displayed in the app and on our website. We reserve the right to modify pricing with reasonable notice.

4.3 Payment Processing

All payments are processed securely by Stripe, our authorized payment processor. By purchasing a subscription, you agree to Stripe's Terms of Service. Stripe handles:

Payment processing and billing
Refund processing
Subscription management

4.4 Cancellation and Refunds

You may cancel your subscription at any time through the app or by contacting our support. Upon cancellation:

Your access continues until the end of the current billing period
No partial refunds are provided for unused time
You can resubscribe at any time

5. Acceptable Use

You agree NOT to:

Use the Service for any illegal purpose
Attempt to reverse engineer, decompile, or hack the Service
Share your account access with others
Use automated tools to access the Service (bots, scrapers, etc.)
Resell or redistribute information from the Service
Interfere with or disrupt the Service or servers
Violate any applicable laws or regulations
Use the Service to send spam or unsolicited messages

Violation of these terms may result in immediate termination of your account without refund.

6. Intellectual Property

The Service, including its original content, features, and functionality, is owned by Quickizz and protected by copyright, trademark, and other intellectual property laws. You may not:

Copy, modify, or distribute our content without permission
Use our trademarks or branding without authorization
Create derivative works based on our Service

7. Disclaimer of Warranties

            THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
        

We do NOT guarantee:

That the Service will be uninterrupted or error-free
The accuracy, completeness, or timeliness of flight information
That you will find or successfully book any flights
Availability of seats shown in our alerts
Compatibility with your airline subscription program

Flight availability changes rapidly and seats may be booked by others before you can complete your booking. We are not responsible for flights that become unavailable.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, QUICKIZZ SHALL NOT BE LIABLE FOR:

Any indirect, incidental, special, consequential, or punitive damages
Loss of profits, data, or business opportunities
Missed flights or travel opportunities
Costs incurred from reliance on information from the Service
Third-party actions, including airlines or payment processors

Our total liability for any claims arising from your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless Quickizz, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

Your use of the Service
Your violation of these Terms
Your violation of any third-party rights
Any content you submit or transmit through the Service

10. Third-Party Services

The Service integrates with and may link to third-party services including:

Messaging platforms: For notification delivery
Payment processor: For payment processing
Airlines: For flight booking (external links)

We are not responsible for the content, policies, or practices of these third parties. Your use of third-party services is subject to their respective terms and policies.

11. Modifications to Service

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation.

12. Flight Predictions

The Predicted Flights feature ("Predictions") provides estimates based on historical flight pattern analysis. Predictions are generated by analyzing publicly available flight scheduling data collected over multiple months.

By using the Predictions feature, you acknowledge and agree that:

a) Predictions do not guarantee that any specific flight will be available for booking on any given date or time.
b) Quickizz is not affiliated with, endorsed by, or connected to any airline. Flight schedules are determined solely by the airlines.
c) Actual flight availability may differ significantly from predictions due to schedule changes, seasonal adjustments, or other factors outside our control.
d) Users should always verify flight availability directly on the relevant airline website before making any travel arrangements.
e) Quickizz bears no responsibility for missed flights, incorrect predictions, travel disruptions, or any decisions made based on prediction data.
f) Prediction data is provided "as is" without warranty of any kind, express or implied, including accuracy, completeness, or fitness for a particular purpose.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on our website and/or sending a notification through the app. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

14. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the Service shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to the exclusive jurisdiction of the courts located in Toronto, Ontario, Canada.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Quickizz regarding your use of the Service, superseding any prior agreements.
